President Joe Biden has greatly reduced required reviews of costly federal agency regulations, opening the door to a new wave of rules to push a liberal agenda that the White House can’t get Congress to agree to, according to a regulatory expert.
From promoting liberal “ESG” policies to requiring that diversity and equity play a key role in regulations, the administration’s new regulatory road map completes a 180-degree reversal of the Trump deregulation agenda, said Clyde Wayne Crews Jr., the regulation expert at the Competitive Enterprise Institute.
“Biden’s ambitions include a damaging ‘competition policy’ that encourages heightened federal meddling in private business and economic affairs, major interventions in the name of ‘climate crisis,’ and most prominently now, trendy, cultish and divisive ‘equity,’ ESG (environmental, social, and corporate governance), and DEI (diversity, equity, and inclusion) pursuits coordinated with suspect legality across agencies throughout the entire federal government,” Crews warned.
“Biden is not coy about his intentions to expand Washington into the economy, finance, medicine; and in our personal lives and social interactions,” Crews added in warnings posted on the CEI website and in Forbes magazine.
Since Biden entered the Oval Office with a stack of executive orders to begin a new era of rule-making by agencies out of the sight of Congress, which ostensibly has to approve the regulations first, Crews has been on a 24-hour watch for action.
In his latest report, he charted several recent moves by Biden to close the curtain on promised transparency of new rules.
In one key move, he said that Biden has raised the cost cap of rules requiring an audit from $100 million to $200 million. Crews said many regulations affecting small businesses will now go unchecked.
He also said Biden has “politicized” regulations to include ESG and DEI considerations.

And, he said, highly regulatory “guidance documents” have been declared off-limits to auditors, though they often reveal new rules and regulations about to hit government contracts and decisions.
Crews called on Congress to tighten its review of regulations, especially as the White House turns to using them more since it lost control of Congress after the GOP won the House in the 2022 elections.
