Establishing a standard in which “no finding of wrongdoing is required” to levy fines against historical actions that were (and still are) legally permitted sets a dangerous precedent
Ex post facto laws are prohibited by the U.S. Constitution. I realize these are state laws, but why couldn’t it be argued that the ex post facto prohibition extends to the states via the 14th amendment? One should not be punished for acts that were legal at the time they were performed. No one is safe under such a regime. I don’t think they can get away with such a travesty of justice.
If this passes, energy companies and petrochemical companies should stop providing services and materials to the state. Cut off all fuel deliveries, no gasoline, no natural gas, no plastic. New York has already banned frac’ing. Why not just go all the way and ban the use of hydrocarbons in the state effective immediately. Maybe because they know it is a product civilization cannot do without. It’s a money grab, plain and simple. The irony is that they would not be taking the money from oil companies but from the consumer since prices would rise to cover the tax.
